
Terms & Conditions
1. Definitions
“Photographer” refers to Rosie Moments Photography.
“Client” refers to any individual, group, or organisation entering into an agreement with the Photographer.
“Session” refers to any non-wedding photography service.
“Wedding” refers to wedding photography services.
“Agreement” refers to the booking form and these Terms & Conditions.

2. Booking & Agreement
A booking is only confirmed once:
A completed booking form has been received, and
The required deposit has been paid
These Terms & Conditions form part of the Agreement between the Photographer and the Client and apply to all bookings.

3. Artistic Licence
The Photographer retains full creative and artistic control over:
Poses
Locations
Editing style
Number of final images delivered
While all reasonable efforts will be made to capture requested images, no specific image or outcome is guaranteed due to factors beyond reasonable control (including weather conditions and subject cooperation).
4. Payments
4.1 Non-Wedding Sessions
A 25% non-refundable deposit is required to secure the booking
The remaining balance is due on or before the session date, unless otherwise agreed in writing

4.2 Weddings
A 25% non-refundable deposit is required to secure the wedding date
The remaining balance is due 8 weeks prior to the wedding date
If the booking is made within 8 weeks of the wedding, full payment is required at the time of booking
Late Payments
A 5-day grace period will be allowed following the balance due date.
If the remaining balance is not paid within this grace period, the Photographer reserves the right to:
Charge a late payment fee of 10% of the outstanding balance, and/or
Suspend or cancel the booking without further notice
If the Photographer cancels the booking due to non-payment, all monies paid will be retained and the Client shall remain liable for any outstanding balance in accordance with the cancellation terms outlined in Section 6.1.
Once confirmed, the agreed wedding fee will not change.
Time shall be of the essence in respect of all payment obligations.

5. Deposits
All deposits are non-refundable and are paid to secure the Photographer’s time, services, and the reservation of the agreed date.
Deposits may be transferred to a new date at the Photographer’s discretion where:
The Client provides reasonable notice, and
The reason is beyond the Client’s control (e.g. illness or severe weather)
Failure to provide sufficient notice (minimum 24 hours for sessions) may result in forfeiture of the deposit.
6. Cancellations & Amendments
6.1 Weddings
Deposits are non-refundable and non-transferable
Cancellation more than 8 weeks before the wedding date: no further payment required
Cancellation within 8 weeks: full balance remains payable
Monthly Payment Plans
Where a payment plan has been agreed, all instalments are non-refundable and non-transferable. Payments are made toward the total agreed fee and do not represent separate services.
In the event of cancellation, the Client shall remain liable for any outstanding balance in accordance with the cancellation terms above.
Failure to maintain agreed monthly payments may result in cancellation of the booking, and all monies paid will be retained.
Missed or late instalments may be treated as a material breach of this Agreement.
Amendments must be submitted in writing no later than 8 weeks prior to the wedding date.

6.2 Non-Wedding Sessions
Deposits are non-refundable and non-transferable
Cancellation or changes:
More than 48 hours before: no additional charge
Within 48 hours: may incur additional fees at the Photographer’s discretion

6.3 Weather & Environmental Conditions
Outdoor sessions will proceed in light rain, damp, or wet ground conditions. The Photographer will assess conditions on the day and reserves the right to continue, modify, or proceed with the session where it is safe to do so.
Rescheduling due to weather will only be offered where conditions are deemed unsafe or unsuitable at the Photographer’s discretion (e.g. heavy rain, extreme weather, or safety risks).
Cancellation or changes:

7. Rescheduling by Photographer
If the Photographer is unable to attend due to circumstances beyond reasonable control:
Reasonable efforts will be made to reschedule or provide a suitable replacement
If this is not possible, liability shall be limited to a full refund of all payments received
​
8. Image Delivery
The agreed fee includes:
The Photographer’s time and expertise
Pre- and post-session communication
Professional editing of images
Final edited images will be delivered via an online gallery within:
4 weeks for non-wedding sessions
8 weeks for weddings
Delivery times are estimates and may vary during busy periods; however, every effort will be made to deliver within the stated timeframe.
Delivery timeframes commence from the date of the session or wedding.

9. Additional Costs
Any additional costs (including but not limited to venue hire, permits, travel, or props) are the responsibility of the Client unless otherwise agreed in writing.

10. Client Responsibilities
The Client agrees to:
Cooperate fully during the session
Ensure all participants (especially minors) are supervised at all times
Adhere to agreed timings and schedules
The Photographer shall not be responsible for reduced coverage resulting from delays, restrictions, or lack of cooperation.

11. Image Delivery & Storage
Only final edited images will be delivered
RAW/unedited files will not be provided
Images will be stored for 12 months, after which they may be permanently deleted
​
12. Orders & Pricing
Prices are valid for 14 days from gallery delivery
Orders placed after this period may be subject to updated pricing
All products remain the property of the Photographer until paid in full
​
13. Loss or Damage
In the unlikely event of loss, damage, or technical failure, the Photographer’s liability shall be limited to a partial or full refund of payments made, depending on the extent of the affected services.
This shall be the Client’s sole remedy.

14. Copyright & Usage
The Photographer retains full copyright of all images
The Client is granted a personal-use licence only
The Photographer may use images for:
Portfolio
Marketing and advertising
Social media
Competitions
Unless the Client requests otherwise in writing prior to the session.

15. Limitation of Liability
The Photographer shall not be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:
Equipment failure
Weather conditions
Illness or injury
Loss or corruption of digital files
Total liability shall not exceed the total amount paid by the Client.

16. Complaints
Complaints must be submitted:
In writing within 7 days of becoming aware of the issue, and
No later than 28 days after receipt of images

17. Entire Agreement
These Terms & Conditions constitute the entire agreement between the parties and supersede all prior communications.
Any amendments must be agreed in writing and signed by both parties.

18. Reservation of Date
The Client acknowledges that upon payment of the deposit, the Photographer reserves the agreed date exclusively for the Client and may decline other bookings.
In the event of cancellation, this loss of opportunity is a genuine pre-estimate of loss and is reflected in the non-refundable deposit.
